These terms are a draft for The Beauty Basement Pty Ltd. They require final Australian and Western Australian legal review before they are treated as lawyer-approved terms. They are written in plain English for people who book a chair or workspace at the Northbridge premises.
1. Who these terms apply to
These terms apply to bookings of a chair or workspace at The Beauty Basement, 89 Aberdeen Street, Northbridge WA 6003, and to entry to those premises in connection with a booking.
They are between The Beauty Basement Pty Ltd ("TBB", "we", "us") and the person who confirms the booking ("you"). If you book for a business, you confirm that you are allowed to bind that business, and "you" includes that business.
These terms apply to the workspace booking and to access that TBB issues for that booking. They are separate from any terms a client accepts when they book an appointment with you.
2. Acceptance
You accept these terms when you confirm the booking, including when you choose Confirm booking, Book & pay, or the equivalent payment or package action on the booking screen. There is no separate signature step.
TBB records the acceptance against the booking, including the terms version, the time of acceptance, and the privacy notice version that applied. That record is kept with the booking. If these terms are later updated, a booking keeps the version that was accepted for it. A later version does not replace the version already accepted for an existing booking.
If TBB cannot record that acceptance, the booking is not treated as confirmed for automatic door access.
3. Bookings and payments
A booking is a request to use the nominated chair or workspace on the dates and for the chair quantities you select.
You must pay the amount shown before the booking is confirmed, unless the screen shows that the booking is fully covered by a TBB credit, package, or approved discount. Prices are in Australian dollars. GST is applied as shown on the booking screen.
Paying a booking, or using credits, does not transfer ownership of any chair, equipment, or part of the premises.
4. Cancellations, changes, refunds and credits
You may ask TBB to change or cancel a booking. Whether a refund, partial refund, or credit is available depends on the timing of the request, whether the time can be rebooked, and any specific rule shown when you booked.
TBB may refuse a change that is not available, that exceeds capacity, or that would leave an amount unpaid.
Credits, package days, and complimentary days can be used only as the booking screen and TBB's records describe. They are not cash, are not transferable unless TBB agrees, and expire if the offer you bought says they expire.
Nothing in this section takes away a refund or remedy you are entitled to under the Australian Consumer Law.
5. Workspace and chair use
You may use the booked chair or workspace for your own lawful beauty, hair, barber, makeup, or related client services during the booking.
You must leave the chair and the surrounding area fit for the next person: clean, safe, and free of your products, hair, and rubbish. You must follow any reasonable instruction given on the day about which chair or area to use.
You must not hold the space out as a tenancy, a partnership with TBB, or a right to any particular chair beyond the booking.
6. Permitted access and hours
You may enter the premises only for a current booking, for an access window TBB has confirmed, or with TBB's separate permission.
The ordinary electronic access window is 6:00 am to 10:00 pm Australian Western Standard Time on each booked day. A booking confirmation or access message may state a different window. Access outside that window is not included.
Being nearby, having visited before, or holding an old code does not entitle you to enter.
7. Electronic and keyless access
TBB may issue a code, pass, or other keyless credential for a confirmed booking. A credential is issued only for that booking and only for the access window.
Automatic credentials are issued only after the booking has a recorded acceptance of these terms and the booking is otherwise eligible. If acceptance is not recorded, TBB will not issue automatic door access for that booking.
You must not share, copy, photograph for someone else, or reuse a code or credential. You must not let another person use your credential to enter. If you think a code has been seen or misused, tell TBB promptly so it can be withdrawn.
8. People you bring in
You are responsible for every client, guest, assistant, model, or other person you allow into the premises in connection with your booking.
You must make sure they enter only while you are there for your booking, follow these terms and any reasonable house rules, and leave when your access window ends. Their conduct is treated as your responsibility for the purposes of these terms.
9. Client and guest conduct
You and your clients and guests must behave safely and respectfully toward other people in the workspace, their clients, and TBB staff or contractors.
You must not harass, threaten, or discriminate against any person. You must not interfere with another person's booking, tools, or clients.
10. Your business, your services, and your clients
You operate your own business. TBB provides a workspace booking. TBB does not provide your services to your clients, set your service prices, or supervise how you perform a treatment.
You are responsible for your advice, your services, your products, your client bookings, your complaints, and your client records. A client of yours is not, only because they attend the premises, a client of TBB.
11. No employment or agency
Using the workspace does not make you an employee, partner, agent, or contractor of TBB. You must not represent that TBB employs you or guarantees your work.
TBB does not deduct tax, superannuation, or workers compensation for you as if you were an employee. You are responsible for your own tax and business obligations.
12. Licences, qualifications and legal obligations
You must hold every licence, qualification, registration, and council or health approval that your services require in Western Australia, and you must keep them current.
You must follow the laws that apply to your services, including health, infection control, advertising, consumer, and privacy laws that apply to your own clients. TBB does not check or warrant that you hold a particular qualification unless TBB has said so in writing for a specific approval.
13. Insurance
You must hold insurance that is appropriate for your services and for your use of the workspace, including public liability insurance, before you work from the premises.
You must give TBB evidence of that insurance if TBB asks. If your insurance lapses, you must not continue to use the workspace until it is in place again.
14. Hygiene, sanitation and safe working practices
You must follow sound hygiene and infection-control practice for your services. That includes clean tools, safe handling of sharps and chemicals, and cleaning the chair and surfaces you use.
You must not work if doing so would create a material health risk to other people in the premises. You must tell TBB promptly about a spill, blood exposure, equipment fault, or other hazard you cause or notice.
15. Equipment and property
Chairs, fittings, and shared equipment remain TBB's property or the property of the person who owns them. You must use them with reasonable care and only for their ordinary purpose.
You must not alter, remove, or store hazardous products in a way that creates a risk. You must not bring in equipment that overloads the power, ventilation, or space without TBB's agreement.
16. Damage
You must promptly tell TBB about damage you cause, or that your client or guest causes, to the premises, a chair, equipment, or another person's property.
You are responsible for the reasonable cost of repairing that damage, except to the extent the damage was caused by TBB or by someone TBB is responsible for, or to the extent the law says you are not responsible.
17. Personal belongings
You are responsible for your own tools, products, phone, and other belongings, and for your clients' belongings. TBB is not a bailee of those items and does not insure them.
Do not leave valuables unattended. Remove your belongings at the end of the booking unless TBB has agreed in writing that you may store them.
18. Security and CCTV
The premises may use locks, alarms, and CCTV for the safety of the people who use the workspace and for the security of the property. CCTV may record common areas and entries.
TBB handles those images under its privacy notice. You must not cover, move, or interfere with a camera or lock.
19. Emergencies and incidents
In an emergency, follow the posted directions, leave if it is unsafe to stay, and contact emergency services if someone is in danger.
Tell TBB as soon as you reasonably can about an injury, a security incident, a fire, a flood, or a dangerous fault. You must cooperate with a reasonable incident inquiry.
20. Prohibited, unsafe and unlawful activities
You must not use the premises for anything unlawful. You must not bring illegal drugs, weapons, or hazardous substances that are not genuinely required for a lawful beauty service and stored safely.
You must not provide a service you are not qualified or permitted to provide. You must not run a photoshoot, event, or extra business from the space unless it is part of your booking and is allowed.
21. Reasonable workspace rules
TBB may set reasonable rules for shared areas, noise, scent, waste, parking, and the order of use. Those rules sit with these terms. A rule will not contradict a non-excludable legal right.
TBB will tell you about a material new rule by the booking screen, email, or a notice at the premises.
22. Suspension or withdrawal of access
TBB may suspend or withdraw access, including a code, where that is reasonably necessary for safety, security, a serious breach of these terms, or non-payment of an amount due for the workspace.
TBB will tell you what has been suspended and, where it can reasonably be fixed, what you need to do. Suspension does not by itself erase a right you have under the Australian Consumer Law to a refund or other remedy where one is due.
23. Liability
TBB is responsible for loss or damage to the extent it is caused by TBB's negligence, breach of these terms, or breach of a non-excludable legal duty.
TBB does not accept liability for your services, your business decisions, or the acts of your clients except where TBB caused or contributed to the loss. TBB is not liable for loss that was not a reasonably foreseeable result of TBB's breach.
These limits do not apply to liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence where the law does not allow that liability to be excluded, and including guarantees under the Australian Consumer Law that cannot be excluded.
24. Indemnity
You indemnify TBB against loss that TBB suffers because of a claim by a third party, to the extent the claim arises from your services, your breach of these terms, or the acts or omissions of you or a person you allow into the premises.
The indemnity is limited to loss that is reasonably connected to those acts or omissions. It does not apply to the extent the loss was caused by TBB's own negligence, breach, or wilful misconduct. It does not require you to cover a penalty or liability that the law says cannot be shifted onto you.
25. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law where that exclusion is not permitted.
If you are a consumer for the purpose of that law, you are entitled to those guarantees. Where TBB is allowed to limit its liability for a failure to comply with a guarantee, TBB limits that liability, to the maximum extent allowed, to resupplying the workspace booking or paying the cost of having it supplied again.
26. Privacy
TBB handles personal information for bookings, payments, and access as described in the privacy notice at /privacy. The privacy notice version recorded with a booking is TBB-PRIVACY-NOTICE-2026-10-05-v1, unless a later acceptance record names a different privacy version.
You must handle your own clients' personal information lawfully. TBB's privacy notice does not replace your privacy obligations to your clients.
27. Disputes
If you have a concern about a booking or the workspace, contact TBB first using the details below and give TBB a reasonable chance to look into it.
If the concern is not resolved, either party may take it to a court or tribunal of competent jurisdiction in Western Australia, including a tribunal that can hear a consumer claim. These terms do not require you to give up a right to complain to a regulator.
28. Western Australian law
These terms are governed by the laws of Western Australia and the laws of the Commonwealth of Australia that apply there. The courts and tribunals of Western Australia have jurisdiction.

30. Changes to these terms
TBB may publish a new version for future bookings. The version identifier will change. A booking that has already been confirmed stays on the version accepted at confirmation. The text of that version remains available for that booking.
